End User License Agreement (EULA)

This End User License Agreement ("EULA") is a legal agreement between you ("User" or "you") and Kanjijo ("Licensor", "we", "our", or "us") for the use of the Kanjijo mobile application ("App").

By downloading, installing, or using the App, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not download, install, or use the App.

1. License Grant

Subject to the terms of this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the App on mobile devices that you own or control.
  • Use the App for your personal, non-commercial educational purposes.

2. License Restrictions

You may not:

  • Copy, modify, or distribute the App or any part thereof.
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
  • Rent, lease, lend, sell, sublicense, or transfer the App to any third party.
  • Remove, alter, or obscure any proprietary notices in the App.
  • Use the App for any commercial purpose without our prior written consent.
  • Use the App to create a competing product or service.
  • Use automated tools (bots, scrapers) to extract content or data from the App.

3. Intellectual Property

The App and all related intellectual property rights are and will remain the exclusive property of Kanjijo. This EULA does not transfer to you any ownership rights in the App. All rights not expressly granted in this EULA are reserved by us.

The App's unique combination of content, design, SRS algorithm, and learning methodology constitutes our proprietary intellectual property.

4. In-App Purchases and Subscriptions

The App offers in-app purchases and auto-renewable subscriptions through the Apple App Store:

  • Monthly Subscription: Provides access to all Premium features for one month. Auto-renews monthly.
  • Lifetime Purchase: One-time payment for permanent access to all Premium features.

All purchases are subject to the Terms of Service and the Apple App Store's terms and conditions. Payment is processed by Apple, not directly by Kanjijo.

5. Auto-Renewable Subscription Terms

  • Payment will be charged to your Apple ID account at the confirmation of purchase.
  • Subscription automatically renews unless it is canceled at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
  • You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase.
  • Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
  • Prices may change. You will be notified in advance of any price changes.

6. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into this EULA by reference. Please review our Privacy Policy to understand how we collect, use, and protect your data.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The App will meet your specific requirements.
  • The App will be uninterrupted, timely, or error-free.
  • The results from using the App will be accurate or reliable.
  • The quality of any content or features will meet your expectations.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KANJIJO BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE APP.

9. Termination

This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies from your devices.

We may also terminate this EULA at any time by providing notice to you through the App or by email.

10. Updates and Modifications

We may from time to time issue updates, upgrades, or modifications to the App. These may be required for you to continue using the App. We may update this EULA from time to time; the updated version will be effective upon posting.

11. Third-Party Services

The App may use third-party services including but not limited to:

  • Google Firebase (Authentication, Cloud Firestore, Analytics, Crashlytics)
  • Apple App Store (Payment processing)

Your use of these third-party services is subject to their respective terms and privacy policies.

12. Export Compliance

You agree to comply with all applicable export and re-export control laws and regulations in your use of the App.

13. Governing Law

This EULA shall be governed by and construed in accordance with the laws of Vietnam. Any disputes arising under this EULA shall be subject to the exclusive jurisdiction of the courts of Vietnam.

14. Severability

If any provision of this EULA is held to be unenforceable, such provision shall be reformed only to the extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
